Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you and ThyncLabs ("ThyncLabs", "we", "us", or "our"), the operator of the ThyncLabs website, applications, and related services (together, the "Service"). By creating an account, purchasing a plan, or otherwise accessing or using the Service, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, please do not use the Service.

These Terms are governed by the laws of India, including the Indian Contract Act, 1872, the Information Technology Act, 2000, the Consumer Protection Act, 2019, and the Digital Personal Data Protection Act, 2023, as applicable.

1. Definitions

• Service / Platform — the courses, practice problems, editorials, code judge, AI mock interviews, and all other features we make available.
• User ("you") — any person who accesses or uses the Service, whether or not registered.
• Content — all material we provide, including lessons, problem statements, editorials, reference solutions, tests, and software.
• User Content — code, notes, whiteboard drawings, transcripts, and other material you create or submit through the Service.
• Subscription — a paid plan that unlocks premium features for a recurring billing cycle.
• Credits — units that entitle you to consume metered features, such as AI mock interviews.

2. Eligibility

The Service is intended for users who are at least 18 years old and able to enter into a binding contract under applicable law. If you are between 13 and 18 years of age, you may use the Service only under the supervision of a parent or legal guardian who agrees to these Terms on your behalf and accepts responsibility for your use. The Service is not directed to children under 13.

3. Accounts and security

You agree to provide accurate and complete information when you register and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Accounts are personal to you and may not be shared, sold, or transferred. Please notify us promptly at hello@thynclabs.com if you suspect any unauthorized access to or use of your account.

4. Communications

By creating an account, you agree to receive transactional communications that are necessary to operate the Service — for example, account notices, purchase receipts, and security alerts. You may also opt in to receive product updates and marketing messages, and you can opt out of those at any time using the unsubscribe link or by contacting us.

5. Plans, pricing, and payments

Some features require a paid Subscription or Credits. Prices are displayed on the Service and, where applicable, are inclusive of Goods and Services Tax (GST). Payments are processed by third-party payment providers; we do not store your full card details. A purchase is confirmed only once payment is successfully authorized and we send you a confirmation. Paid Subscriptions renew automatically at the end of each billing cycle at the then-current price until cancelled. We may change prices from time to time; any change applies to the next billing cycle after we give you reasonable notice.

6. Refunds and cancellation

You may cancel a Subscription at any time from your account settings. On cancellation, your access continues until the end of the current paid cycle, and the plan does not renew thereafter. Because the Service delivers digital content and services that are accessed immediately, fees already paid are generally non-refundable once the relevant content or feature has been accessed, and Credits are non-refundable once issued, except where a refund is required by law or where content is materially defective or was misrepresented. Nothing in this section limits any rights you may have under the Consumer Protection Act, 2019.

7. Fair use of Subscriptions and Credits

Subscriptions and Credits grant a personal, non-transferable right to use the Service. To keep access fair for everyone, you agree not to share your account, use it across an unreasonable number of concurrent devices, resell access, exploit regional pricing, or use automated means to access the Service beyond ordinary personal use. We may apply reasonable measures — including notice, rate limits, or suspension — to address misuse.

8. Your content

You retain ownership of the User Content you create or submit. You grant ThyncLabs a limited, worldwide, royalty-free license to host, store, process, and display that content solely to operate and improve the Service — for example, to run your submissions in the code judge, generate AI feedback and reports, and show your history and progress back to you. You represent that you have the right to submit your User Content and that it does not infringe the rights of others or violate any law.

9. AI features

The Service includes AI-assisted features such as complexity analysis, coaching, interview conduct, and scoring. To provide these, relevant content may be processed by third-party AI providers acting on our behalf. AI outputs are practice aids and estimates intended to support your preparation; they are not guarantees of accuracy and do not guarantee any interview result, assessment, or hiring outcome. You should not rely on them as professional, legal, financial, or career advice.

10. Intellectual property

The Service and all Content, including its courses, problems, editorials, branding, and software, are owned by or licensed to ThyncLabs and are protected by intellectual-property laws. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, and non-commercial license to access and use the Content for your own interview preparation. All rights not expressly granted are reserved.

11. Acceptable use

You agree not to:

• copy, record, resell, scrape, or redistribute Content, problems, or editorials;
• share your account, or circumvent access, security, or usage limits;
• abuse, reverse-engineer, probe, or overload the code judge, AI features, or infrastructure;
• upload unlawful, infringing, defamatory, or malicious content, or malware;
• impersonate any person or misrepresent your affiliation; or
• use the Service for any purpose that is unlawful or prohibited by these Terms.

12. Third-party services and links

The Service may integrate with or link to third-party websites and services (for example, payment, authentication, and AI providers). We are not responsible for the content, policies, or practices of those third parties, and your use of them is governed by their own terms.

13. Changes to the Service

We are continually improving the Service and may add, modify, or discontinue features with reasonable notice where practicable. We are not liable to you for any modification, suspension, or discontinuation of the Service, except as required by law.

14. Force majeure

Neither party is liable for any failure or delay in performance caused by events beyond its reasonable control, including natural disasters, epidemics, war, civil unrest, failures of power or telecommunications networks, cyberattacks, or acts of government.

15. Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that it will result in any particular interview performance, assessment, or job offer. The Service is a supplementary preparation tool and not a substitute for your own study and judgment.

16. Limitation of liability

To the maximum extent permitted by law, ThyncLabs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or opportunity. Our total aggregate liability for any claim arising out of or relating to the Service is limited to the amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including for fraud or gross negligence.

17. Indemnification

You agree to indemnify and hold harmless ThyncLabs and its team from any claims, damages, losses, and reasonable expenses arising out of your breach of these Terms, your User Content, or your misuse of the Service, to the extent permitted by law.

18. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, engage in fraud or chargeback abuse, share your account, or use the Service in a way that risks harm to others or to the Service. On termination, the licenses granted to you end, and sections that by their nature should survive — including those on intellectual property, disclaimers, liability, and governing law — will continue to apply. Termination does not entitle you to a refund except where required by law.

19. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Subject to any rights you may have as a consumer under the Consumer Protection Act, 2019, the courts at Bengaluru, Karnataka will have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service.

20. Grievance redressal

In accordance with applicable Indian law, you may raise any grievance regarding the Service or your User Content with our Grievance Officer, reachable at hello@thynclabs.com, by phone at +91 92412 99173, or by post at 304, Green Glen Layout, Bellandur, Bengaluru, Karnataka, India — 560103. We aim to acknowledge grievances within 48 hours and to resolve them within a reasonable period, typically 30 days.

21. General

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right or provision is not a waiver of it. We may assign these Terms as part of a merger, acquisition, or sale of assets; you may not assign your rights without our consent. These Terms constitute the entire agreement between you and ThyncLabs regarding the Service.

22. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you and update the date above. Your continued use of the Service after the changes take effect means you accept the updated Terms.
